VL.Stride.SDFToMesh License Agreement

1. Introduction

This License Agreement ("Agreement") is between Tebjan Halm ("Licensor") and the user ("Licensee") of the VL.Stride.SDFToMesh software and associated documentation ("Software"). By downloading, installing, or using the Software, the Licensee agrees to be bound by the terms of this Agreement.

2. Grant of License

1. Non-Commercial Use: Licensor hereby grants Licensee a revocable, non-exclusive, non-transferable license to use the Software for non-commercial purposes, free of charge. Non-commercial purposes include evaluation of the Software, student projects, hobby projects, and use by educational institutions for teaching purposes. Any use of the Software that directly or indirectly results in commercial advantage or monetary compensation is outside the scope of this license.

2. Commercial Use: Use of the Software for commercial purposes is strictly prohibited under this license without obtaining a separate license from the Licensor. Licenses for commercial use are negotiated on a case-by-case basis, considering factors such as project size, customer wealth, and living costs in the respective area. 3. Restrictions

Licensee shall not:

Modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software, except for the purpose of improving the code and contributing the improvements back to the Licensor's codebase. Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make the Software available to any third party for any reason, without the prior written consent of Licensor.

4. Intellectual Property Rights

The Software includes modified code from a GitHub repository by the user tuntenfisch, which is licensed under the MIT License. All intellectual property rights in the original and modified Software remain the property of the Licensor, except as expressly licensed under this Agreement.

5. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. The Licensor disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

6. Limitation of Liability

The Licensor will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Software, regardless of the legal theory, even if advised of the possibility of such damages.

7. Termination

This Agreement is effective until terminated. It will terminate automatically without notice from the Licensor if the Licensee fails to comply with any of its terms. Upon termination, the Licensee must cease all use of the Software and destroy all copies.

8. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through arbitration or mediation when possible. Court litigation shall be a last resort and conducted under the jurisdiction most commonly associated with software license agreements.

9. Agreement Updates

Updates to this Agreement will be communicated through updates in the Software repository or codebase. Licensees are responsible for reviewing the Agreement periodically for changes.
